  11. NOTICE  TO  USERS:  CAREFULLY READ THE FOLLOWING LEGAL
  12. AGREEMENT. USE  OF THE  SOFTWARE  PROVIDED  WITH  THIS
  13. AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE
  14. OF  THESE  TERMS. IF YOU DO NOT AGREE TO  THE TERMS OF
  15. THIS   AGREEMENT,  DO  NOT  INSTALL  AND/OR  USE  THIS
  16. SOFTWARE. USER'S USE OF THIS SOFTWARE  IS  CONDITIONED
  17. UPON  COMPLIANCE  BY  USER  WITH  THE  TERMS  OF  THIS
  18. AGREEMENT.

  20. 1. LICENSE GRANT.

  22. Nikeware, grants you a license to  use one copy of the
  23. version of this SOFTWARE on any one system for as many
  24. licenses  as  you  purchase. "You" means  the company,
  25. entity or individual  whose funds are used to pay  the
  26. license fee. "Use" means storing, loading, installing,
  27. executing or displaying the SOFTWARE.
  28.  
  29. You  may  not  modify  the  SOFTWARE  or  disable  any
  30. licensing or control features  of  the SOFTWARE except
  31. as  an  intended  part  of  the SOFTWARE's programming
  32. features.When you first obtain a copy of the SOFTWARE,
  33. you are  granted an evaluation period of not more than
  34. 30 days,  after achievement of this limit you must pay
  35. for  the  SOFTWARE according to the terms  and  prices
  36. discussed in the SOFTWARE's documentation, or you must
  37. remove the SOFTWARE from your system. This license  is
  38. not transferrableto any other system,  or  to  another
  39. organization or individual.

  41. 2. OWNERSHIP.

  43. The SOFTWARE is owned and copyrighted by Nikeware,Your
  44. license confers  no title or ownership in the SOFTWARE
  45. and  should not be construed as a sale of any right in
  46. the SOFTWARE.

  48. 3. COPYRIGHT.

  50. The SOFTWARE is protected copyright law and
  51. international  treaty provisions. You acknowledge that
  52. no title to the intellectual property in the  SOFTWARE
  53. is  transferred  to you.  You further acknowledge that
  54. title  and  full  ownership  rights  to  the  SOFTWARE
  55. will  remain the exclusive  property  of  Nikeware and
  56. you will not acquire any rights to the SOFTWARE except
  57. as expressly set forth in this license. You agree that
  58. any  copies  of  the  SOFTWARE  will contain the  same
  59. proprietary notices which appear on and in the SOFTWARE.

  61. 4. REVERSE ENGINEERING.

  63. You  agree  that  you  will  not  attempt  to   reverse
  64. compile, modify, translate, or disassemble the SOFTWARE
  65. in whole or in part.

  67. 5. NO OTHER WARRANTIES.

  69. Nikeware  DOES  NOT WARRANT THAT  THE SOFTWARE IS  ERROR
  70. FREE.  Nikeware  DISCLAIMS  ALL  OTHER  WARRANTIES  WITH
  71. RESPECT  TO  THE SOFTWARE,  EITHER EXPRESS  OR  IMPLIED,
  72. INCLUDING  BUT  NOT  LIMITED  TO  IMPLIED  WARRANTIES OF
  73. MERCHANTABILITY,  FITNESS  FOR  A PARTICULAR PURPOSE AND
  74. NONINFRINGEMENT OF THIRD PARTY RIGHTS.
  75. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED
  76. WARRANTIES  OR  LIMITATIONS  ON  HOW  LONG  AN   IMPLIED
  77. WARRANTY MAY LAST, OR  THE  EXCLUSION  OR LIMITATION  OF
  78. INCIDENTAL  OR  CONSEQUENTIAL  DAMAGES,   SO  THE  ABOVE
  79. LIMITATIONS  OR  EXCLUSIONS  MAY NOT APPLY TO YOU.  THIS
  80. WARRANTY  GIVES  YOU  SPECIFIC LEGAL RIGHTS AND  YOU MAY
  81. ALSO  HAVE OTHER RIGHTS  WHICH VARY FROM JURISDICTION TO
  82. JURISDICTION.

  84. 6. SEVERABILITY.

  86. In  the  event  of  invalidity  of any provision of this
  87. license, the parties agree  that  such invalidity  shall
  88. not  affect  the  validity  of the remaining portions of
  89. this license.

  91. 7. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

  93. IN  NO  EVENT   SHALL  Nikeware  OR  ITS   SUPPLIERS  BE  
  94. LIABLE   TO   YOU   FOR   ANY   CONSEQUENTIAL,  SPECIAL,
  95. INCIDENTAL  OR  INDIRECT DAMAGES  OF  ANY  KIND  ARISING
  96. OUT OF THE DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE,
  97. EVEN  IF   Nikeware HAS BEEN  ADVISED OF THE POSSIBILITY
  98. OF SUCH DAMAGES.  IN  NO EVENT  WILL Nikeware' LIABILITY
  99. FOR ANY CLAIM,  WHETHER  IN CONTRACT, TORT  OR ANY OTHER 
  100. THEORY  OF  LIABILITY,  EXCEED  THE  LICENSE FEE PAID BY
  101. YOU,IF ANY.

  103. 8. ENTIRE AGREEMENT.

  105. This is the entire agreement between  you  and  Nikeware
  106. which supersedes  any prior  agreement or  understanding,
  107. whether written or oral, relating to the subject  matter
  108. of this license.

  110. 9. RESERVED RIGHTS. 
  111. All rights not expressly granted here are reserved
  112. to Nikeware.
